    Although I applaud what he did and the scumbags got what they deserved, I have a
    question.

    What is the legal position of somebody playing "cop" like this? Normally, you have to
    use as a defense for deadly force something like "I feared for my life and I wanted to stop
    the person from harming me". Stating that "I wanted to prevent a robbery" isn't the same.

    Did they threaten him directly? I don't think so. Therefore, what's the opinion of the LEO's
    here (I know there are a number of you). Just want to know in case.

    Each State has some differences regarding wording, but fear of great bodily harm or death and defense of yourself or others are the keys. I watched it and he should have had a more lethal round. I'm sure some activist will try to make an issue but it looks good to me. Monday morning quartebacks will now step forward with the what if's.

    #1, he only hit one of them I believe so more 'lethal' round would not have done much good and we don't even know where he was hit.
    #2, he may be in trouble, could be in trouble. Why? Because he kept shooting after they were re-treating, when he or no one was in immediate danger (that is also a "key"). The last shot aimed out the door at a guy laying on the ground was especially stupid, bullet could have went any where!
    They are still 'investigating' so could still file charges!
    PS; I am no activist, I am saying (#2) what several lawyers said on Fox News. "It ain't over till the fat lady sings!"

    Where could you find a jury that would convict him? Looks like he saved many people from getting robbed and maybe shot.

    Depends on the laws of the state. In some states, like mine, he would probably be ok.

    As far as Jury nullification; It took the Noo Yawk authorities several attempts to convict Bernard Goetz of anything and he had made himself a decoy with the intention of gunning down some bad guys. He was never convicted of anything except the firearms possession charge. One reason was that everytime the guys he shot were in court they scared the hell out of everybody.

    too bad this old guy wasn't in the movie theater in Aurora, CO.
    I have an interesting comment to make about that.
    Supposing, Mr CCW was in the theater and everything goes Code RED (like it did)
    Mr CCW pulls out his 45 Auto or his 357 magnum and blows a whole through "the joker".
    UNFORTUNATELY, the bullet passes through the joker and hits and innocent bystander also.
    I'd be WILLING to BET you that "the joker" would have "more rights" then Mr. CCW !!!

    Yeah right! This guy was coverd in Kevlar from his head to his knees. Only a direct hit in this idiots face would have put this him down. Nothing a man can carry and shoot with one hand would have been effective here.

    As far as right go. Touch off a round and you are ultimately responsible for where that projectile goes. Shoot, miss, put one through somebody in that theater and darn skippy you're responsible for that one.

    I sure wish the old timer would have laid them both out on the floor "bleeding and begging" and then croaking.

    Would have been a great message for the rest of the thugs in the hood to watch out in whitey town, they've had enough.
